TOIL

TOIL, short for time off in lieu, is paid time off given instead of extra pay for extra hours already worked.

Australian awards and enterprise agreements often set when overtime must be paid and when time off can be taken instead. There is no single national TOIL rule. Penalty rates for evenings, weekends, and public holidays are a separate award question from whether extra hours can be banked as time off. Casual loading is also separate: it is a loading on ordinary hours, not a TOIL balance.

If the award requires overtime pay for those hours, a handshake TOIL arrangement does not rewrite it.
